HIV CRIMINALIZATION

On September 23, 2011, Barbara Lee (D-CA) introduced the Repeal HIV Criminalization Act that ended
laws that imposed cruel and unfair penalties on HIV-Positive people in the U.S. This Repeal  HIV Criminalization Act called for a  review of  all federal and State laws regarding the criminal prosecution of
individuals for HIV-related offenses which targeted HIV-Positive people.
A New Jersey law that requires people with HIV to disclose their status to partners before having sex found
that this was not an effective tool to prevent the spread of HIV. Participants were just as likely to disclose that they have HIV to sex partners as those who was unaware of the law. Many states, like New York, do
not have HIV Criminalization Laws. The question is who is responsible for disclosure when two consenting
Adults have sex? Is HIV Criminalization about punishment and revenge, or is it about prevention and cure?
